As a matter of practice, the Âé¶¹´«Ã½o does not comment on pending litigation.
Regarding the protest that occurred on May 1, 2024, and protesters’ attempted encampment on university grounds, the university publicly described in previous statements why arrests were made under existing policy at the time.
The decision to arrest individuals occurred after multiple discussions, communications and warnings to protesters. In making the arrests, UB Police prioritized the safety and security of the entire university community by upholding and enforcing all applicable laws, SUNY rules and UB policies:
- While members of the university community have the right to peaceful assembly, it was a violation of university policy to erect encampments on the UB campus or assemble overnight.
- On multiple occasions, university staff and University Police communicated UB’s Picketing and Assembling Policy and SUNY’s Rules for the Maintenance of Public Order to the protesters—some of whom were affiliated with UB and many others who were not.
- Most of the protesters initially complied with the requests. However, an additional wave of protesters—some affiliated with UB and many who were not—came onto campus during the late afternoon and evening. Once again, University Police communicated UB’s policies to the protesters.
- ·After repeated communications, discussions and distributions of handouts articulating UB’s policies, the second wave of protesters refused to comply with university and SUNY policies.
- To ensure the safety and security of the entire university community, University Police, after multiple conversations with the protesters, told the protesters that overnight assemblies are not allowed and they would therefore need to take down their encampment but could stay and demonstrate until dusk, in accordance with university policy.
- The protesters asked if they could stay until after dusk to pray. University Police provided the students with the space and time for prayer, extending the timeline for compliance.
- Many protesters complied with the timeline; some did not. A small group of protesters were charged with loitering, disorderly conduct and trespassing. Of that group, eight were unaffiliated with UB and seven were UB students.
